Contract

Term of validity of offers of sales

Delivery

NRJSolar undertakes to do everything in its power to deliver the order in the shortest possible time, as soon as the order is received. Price

The "Boutique" indicates the prices in euros including all taxes, excluding postage. The amount of the VAT and the shipping costs appear on the screen at the end of the selection of the different products by the customer. NRJSolar reserves the right to modify its prices at any time but the products ordered are invoiced at the price in force at the time of the registration of the order. The payment of the order is payable in advance in a payment when sending to NRJSolar the purchase order, except for payment in cash on delivery.

Withdrawal period

How to exercise the right of withdrawal

The return of the goods by the Customer

The Client returns the goods to NRJSOLAR at the address indicated when the return is confirmed by e-mail or telephone.
Important: direct deposits of goods by the customer at this address are not accepted. For goods weighing more than 30 kg, delivered by carrier, after contact with the Customer Service, NRJSOLAR can organize the return by appointment with the carrier designated by NRJSOLAR. Expenses incurred in connection with such return shall be borne by the Customer. In this case, NRJSOLAR will ask for a financial contribution of up to 1 euro per kilo transported. The weight of the products delivered is indicated on the delivery note of the package. By requesting this method, the customer expressly accepts the deduction of this sum of the refund for the withdrawal. This shall be done without undue delay and no later than fourteen days after notification of its decision to withdraw.
The Customer shall bear only the direct costs of returning the goods.

Customer's refund

Principle
When the right of withdrawal is exercised, NRJSOLAR is obliged to reimburse the Customer for all amounts paid, including delivery costs, without undue delay and no later than thirty (30) days from the date on which NRJSOLAR is informed of the Customer's decision to withdraw. NRJSOLAR may defer refund until recovery of the goods or until the Customer has provided proof of the shipment of such goods. Reimbursement will be made by NRJSOLAR by check or wire transfer.

Limits to the right to reimbursement
In addition to the cases set out above, it is recalled that the Customer may be held liable by NRJSOLAR in particular
- deterioration of property resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of such property
- any damage caused to the product from the receipt of the goods by the Customer and until the return of the product to the point of return at NRJSOLAR.
- incomplete return of the goods and their accessories without packaging, instructions for use, documentation
In such cases, the amount that may be retained on the refund of the product or requested from the customer may amount to:
- 100% of the price of the property during a damaged product
- 50% of the price of the property concerned in case of used product
- 50% of the price of the property in the absence of return of the accessories,
- 10% of the price of the goods in the absence of return of the packaging, or of its instructions or documentation

Legal Warranty
The Customer may in any event avail himself of the legal guarantee of conformity provided for in the Consumer Code, in particular the following articles: Article L.211-4: "The seller is obliged to deliver goods in conformity with the contract And responds to defects of conformity existing at issue. Warranty NRJSolar

Definition of the guarantee
NRJSolar applies the national warranty for one, two years or three years on the devices (see duration stipulated in the data sheets and / or the NRJSolar invoice). The warranties and their terms are based on warranties granted by the respective manufacturers of the products, NRJSolar can not replace the suppliers to provide the guarantee.
The product is guaranteed if accompanied by its purchase invoice. The warranty covers the products in their purchase configuration and if their serial number remains legible. The guarantee is valid in metropolitan France. In other cases, the cost of transport to and from France shall be borne by the customer.

Conditions of care
The warranty includes parts and labor. Replaced parts are warranted for the remaining warranty period. The warranty applies excluding the exclusions defined below. The appliance must be sent to the After Sales Service. The NRJSolar warranty includes free access to telephone support for 1 year.

Failure to unpack
Should a defect occur in the unpacking that prevents the use of the product in its expected configuration, the Customer must contact NRJSolar within 72 hours. The product will then be exchanged (excluding breakage during assembly and missing parts).

Exclusions from warranty
The NRJSolar warranty does not apply to:
- in case of accidental material damage. In particular, it does not cover damages and breakdowns resulting from improper installation, assembly or use of the product, use for professional or commercial purposes, normal wear and tear, maintenance ...
- in case of indirect damage.
The NRJSolar warranty covers only the right to repair or replace the guaranteed product. Consequently, indirect damage resulting from the breakdown or deterioration is not covered by the guarantee.
- Other exclusions by nature are damage and breakdowns falling within the specific exclusions provided for in the manufacturer's warranty of the guaranteed product, cosmetic damage, deterioration and breakdowns related to accessories, etc.
 

Protection of personal data

Payment Terms

Unless otherwise stipulated, payments must be made upon order. Any delay or failure to pay the sums due to NRJSolar may automatically and automatically give rise to interest at the prevailing legal interest rate plus two points, without prejudice to any claim for damages from NRJSolar.

Orders are subject to French law. The contractual information is presented in French and the products offered for sale comply with French regulations. Litigation in EU countries

As of 09/01/2016 Regulation (EU) N ° 524/2013 on the "Online regulation of consumer disputes" comes into force.

The ODR (Online Dispute Resolution) Regulation aims to introduce an independent, impartial, transparent, efficient, timely and fair extrajudicial procedure for the settlement of disputes arising from the online sale of goods or services between the different EU countries .
